TERMS AND CONDITIONS OF USE OF GEORENT.CL

GENERAL CONDITIONS

GEORENT, a business division of Tecnoffice Chile SPA, a company duly incorporated and existing under the laws of Chile (hereinafter the "Company" or "Georent.cl"), is the owner of the domains Georent.cl and other national domains derived from its name (hereinafter the "Site"), through which users access a Web platform whose purpose is to allow duly registered users, hereinafter Offerors, to enter content to offer a good or service; and, on the other hand, to allow users, not necessarily registered, hereinafter Customers, to search for content entered by Offerors, for the use of the good or service.

Below are the "Terms and Conditions" applicable to use of the Site. These Terms and Conditions constitute the rules governing use of the Site by Offerors. Any Offeror wishing to access the Site to enter content with the aim of having it offered through the Georent platform may do so by registering and adhering to these Terms and Conditions, together with all other policies and principles governing the Site that may be incorporated herein by reference.

By using GeoRent's Services, the User declares that they are of legal age and gives their free, prior and express consent to the Terms and Conditions detailed herein.

ANY PERSON WHO DOES NOT ACCEPT THESE TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE SITE AND/OR THE SERVICES.

1. Purpose of the Site

The purpose of Georent.cl is to give its registered users, Offerors, the ability to enter content to offer a good or service over the internet through geolocation using the Georent.cl platform, and, on the other hand, to give unregistered users, Customers, the ability to find a good or service published on Georent.cl based on the geolocation in effect at the time of the search on the geolocation maps.

2. Scope of these Terms and Conditions

These Terms and Conditions apply only to the Services and Content offered directly on the Site and not to those that users may access through a hyperlink (link) and/or any other navigation tool located on the Site that directs them to another Website, so Georent.cl is not responsible for the content and privacy policies of such Websites, which are governed by their own Terms and Conditions.

These Terms and Conditions are complemented by Georent.cl's privacy policy, which sets out the use of the personal data of registered users and offerors who make use of Georent.cl.

The Terms and Conditions also govern the liabilities arising from the malicious use of its texts, graphics, drawings, designs, code, software, photographs, music, videos, sounds, images, multimedia elements, expressions and information, as well as any other creation (hereinafter the "Content").

3. Amendments to the Terms and Conditions

Georent.cl may amend the Terms and Conditions at any time by making the amendments and the new terms and conditions public, without the need for prior notice to its users. The new Terms and Conditions will take effect five (5) calendar days after publication. Within three (3) calendar days following publication of the amendments introduced, the offeror may send an email to georent@tecnoffice.cl stating that they do not accept them; in that case the contractual relationship will be terminated and the offeror's account disabled, provided they have no pending obligations. Once this period has elapsed, if the offeror has not raised any objection, they will be deemed to accept the new terms.

4. Jurisdiction and Applicable Law

These Terms and Conditions are governed by the laws in force in Chile. Through this document, you, as an offeror, give your consent to the exclusive jurisdiction and territorial competence of the courts established in Chile for all disputes arising from, or in connection with, access to or use of the Site.

5. Capacity

An offeror who registers as a Company must have sufficient powers to offer on behalf of that entity and to bind it with respect to these Terms and Conditions. For purposes of these Terms and Conditions, "Company" means any legal entity validly and legally existing within the territory of the Republic of Chile where it was incorporated.

7. Reserved Rights

Georent.cl expressly prohibits modifying, copying, reusing, reproducing, exploiting, transmitting, publicly communicating, making second or subsequent publications, uploading files, using, processing or distributing in any way all or part of the Content of the Site for public or commercial purposes, without the prior authorization of Georent.cl or the relevant rights holder.

Any infringement of the foregoing will be considered an infringement of the intellectual property rights held by the offerors, giving rise to the corresponding legal actions against those responsible.

Customers have the right to review all information published on the Site; its use for commercial purposes other than those of the GeoRent.cl site itself is strictly prohibited.

8. Information Published on the Site

Georent.cl is not responsible for the authenticity and accuracy of the information published by offerors on the Site, since this information is provided directly by the offerors who publish it, who are solely responsible for its authenticity and accuracy.

Georent.cl does not verify the data provided by users. The Site is not responsible for the quality of the good or service offered on it, nor does it assume any liability in the event of economic or moral damages arising from any commercial contracts and/or agreements originating from the information contained on it.

If a customer considers that the information published by an offeror is incorrect, misleading or not up to date, they must contact the offeror responsible for that listing directly.

The information published on the Site does not constitute a contractual document and is published for informational purposes only.

9. Liability

Georent.cl does not guarantee, nor is it responsible for:

  • Any negative side effects resulting from a breach of the website's security measures.
  • The absence of computer viruses, malware and/or other harmful elements on the website or on the server hosting it.
  • Compliance by offerors with their obligations to customers and vice versa.
  • Any inaccuracies in the data or characteristics of a good or service.
  • The availability of the published goods or services.

10. Notices

Notices and/or amendments made on the site will be given by means of a notification through Georent.cl and will be considered duly communicated from the moment they are published on Georent.cl.

11. Types of Users on Georent.cl

Georent.cl has the following types of users of its web platform:

Customers: A user who accesses one or more pages of information published on the Site in search of content, without being required to identify themselves for such access.

Offerors: A user who completes the registration process on the Site, which requires completing the corresponding form with the minimum identification data in order to publish content offering a good or service.

12. Security

Georent.cl will seek to adopt the security and personal data protection levels legally required, and has installed all the technical means within its reach to protect the confidentiality of the information provided by offerors.

Notwithstanding the foregoing, security levels on the Internet are vulnerable, so Georent.cl does not guarantee the total and absolute inviolability of its Servers and access to the information contained therein, nor the flawless operation of its protection mechanisms.

Georent.cl will not be responsible for any breach by third parties that allows access to offerors' information occurring without fault on the part of Georent.cl.

II. VISITORS

1. General

Using the Site as a customer does not require providing any personal information.

2. Information

As already indicated, Georent.cl is not responsible for the authenticity and accuracy of the information published by offerors on the Site, since this information is provided directly by the offerors who publish it, who are solely responsible for its authenticity and accuracy.

Notwithstanding the above, Georent.cl will make its best efforts to maintain the highest update standards so that the information provided by offerors is as accurate to reality as possible.

3. Liability

Georent.cl will not be liable for any damages a visitor may suffer due to inaccurate information published on the web platform or failure to comply with these Terms and Conditions.

III. REGISTERED USERS

1. Information Provided to Georent.cl and Data Storage

The Site only stores data from offerors at the time they register.

2. Mandatory Registration

To use Georent.cl as an offeror, mandatory registration is required (the "Registration"); through this process, users authorize the incorporation of this information into a personal record owned by Georent.cl.

Through Registration, users also authorize:

  • Its classification and use to facilitate proper use of the Site;
  • User identification for personalized Services;
  • Statistical studies aimed at improving the Services;

Georent.cl is entitled to use information collected automatically that does not contain users' personal identification.

The foregoing entitles Georent.cl to inform third parties, among other things, about the number of visits, types of visits, visitor searches, and the most visited information within the Site.

In the Registration form, refusal to provide data classified as mandatory will make it impossible to access the Site to publish a good or service.

By sending an email to georent@tecnoffice.cl, the offeror may terminate the publication of their content, request that their profile be deactivated, and will be obligated to delete their content provided there are no pending obligations owed by the offeror to Georent.cl.

3. Data Deletion

By providing their data during Registration, the offeror declares that the information provided is true and lawful. Georent.cl reserves the right to unilaterally delete all data belonging to offerors who:

  • Are suspected of providing false information, or whose falsity is proven;
  • Have mistaken information or information belonging to other users;
  • Intend to use the Site for purposes other than the Services set out in these Terms and Conditions.

GEORENT WILL NOT BE RESPONSIBLE FOR ANY DAMAGES, OF WHATEVER NATURE, THAT MAY RESULT FROM IDENTITY THEFT OF A THIRD PARTY ON THE SITE.

4. Obligations of Registered Users

The Registered User, Offeror, undertakes to:

  • Not impersonate third parties.
  • Make proper use of the Site and its Services and safeguard the confidentiality of their password for accessing content publishing.
  • Use the Content correctly and lawfully.
  • Refrain from using the Content for purposes or effects contrary to law, morals or public order.

WHENEVER AN OFFEROR PUBLISHES CONTENT OR INFORMATION OF ANY KIND ON GeoRent.cl (TEXTS, PHOTOGRAPHS, VIDEOS OR ANY OTHER RECORDING) FOR INCLUSION ON THE SITE, THE OFFEROR DECLARES, WARRANTS AND AGREES THAT THEY HOLD OWNERSHIP RIGHTS OVER THEM AND THAT SUCH INFORMATION DOES NOT INFRINGE ANY INTELLECTUAL PROPERTY, TRADEMARK, PATENT, TRADE SECRET OR ANY OTHER THIRD-PARTY RIGHT. IN ADDITION, THEY AGREE TO GRANT GeoRent.cl, ON A NON-EXCLUSIVE, INDEFINITE AND REVOCABLE BASIS, THE RIGHT TO USE, REPRODUCE, MODIFY, ADAPT, PUBLISH AND TRANSLATE SUCH CONTENT ON THE SITE.

IV. OFFERORS

1. General

Anyone wishing to offer a good or service must be registered as an Offeror.

2. Obligations of the Offeror

  • No Offeror may publish and/or refer to another Website within their listing, except with the prior express authorization of GeoRent.cl.
  • The Offeror may only publish and/or refer to their contact details in the fields intended for that purpose, i.e. "contact details" fields, and not in "description" or "title" fields or any other means not intended for that purpose.
  • The Offeror declares that their purpose is to offer the published good or service and completely excludes any abuse or misuse of the listing for purposes other than those stated as the site's purposes.
  • To keep content as up to date and accurate as reasonably possible.
  • To inform Georent.cl if they no longer wish to keep their listing.

3. Offeror's Liability

Georent.cl will not be liable for any damages the Offeror may suffer due to misuse by third parties outside the site of the information they have entered on the Site.

4. Powers and Liability of Georent.cl

Georent.cl reserves the right to remove listings and/or remove an Offeror if it suspects any improper, erroneous, misleading conduct, or conduct that violates the law, morals and/or public order of the Site.

For this reason, Georent.cl may remove, without prior notice, any data, web address or element referring to a site other than Georent.cl, whose inclusion has not been duly agreed and authorized by Georent.cl.

Georent.cl will not link to other Websites unless this has been previously agreed with Offerors as part of the contracted or offered services, or is part of the site's business strategy.

V. LISTINGS ON GEORENT.CL

1. Handling of Minimum Information by Georent.cl

Offerors accept that Georent.cl may classify and edit the Minimum Information and any other additional information. This authority also covers images, general description elements and other attached information, which may even be published in other sections of the Site.

2. Accuracy of the Listing

Georent.cl does not review or confirm the accuracy of the information in content listings; nevertheless, it retains the authority to remove any information that violates morals and/or public order.

VI. SUPPORT

1. General

The Georent.cl web platform is designed to be operated autonomously and intuitively by its Users.

2. Features

Support may be provided by phone, email or in person. If an in-person visit is requested, the Offeror will be informed of it, along with the associated fee.
